By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

NegosyoNow processes personal data in accordance with the Data Privacy Act of 2012 (RA 10173) of the Philippines and where applicable, the General Data Protection Regulation (GDPR) and the ePrivacy Directive of the European Union. 1. USE OF THE SERVICE

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not misuse the platform, interfere with its operation, or attempt unauthorized access to any part of the Service.

2. PURCHASES

When purchasing any product or service made available through the Service, you may be required to provide accurate and complete information, including:

  • Name
  • Email address
  • Contact number
  • Delivery or pickup address

You agree that NegosyoNow may verify this information as necessary to complete the transaction.

3. SPECIAL PACKAGING

Certain items may require special packaging—such as styrofoam coolers, insulated boxes, or other protective containers—to preserve product quality or ensure safe transport.

  • Packaging fees depend on transport method, container type, size, and weight.
  • All charges will be presented for your approval before processing.
  • Packaging fees must be settled in accordance with the Payments section.

4. ORDER FULFILLMENT

You may receive your items through (a) pick up from designated locations, (b) delivery, or (c) other logistics arrangements, depending on what the Seller supports. The rules below apply based on the fulfillment method chosen.

4.1 Pick Up

    Pick up may be done personally or through your own courier, rider, representative, or logistics provider.

  • Pick up is allowed only during the specified operating hours of the designated pick up points.
  • Once verified, your courier, rider, representative, or logistics provider is considered your authorized agent.
  • The transaction is deemed complete upon turnover of the goods at the pick up point.
  • Neither NegosyoNow nor the Seller will be liable for any incidents occurring during transport, including:
    • Damage
    • Spoilage
    • Tampering
    • Pilferage
    • Loss
    • Delays
  • You are solely responsible for booking, coordinating, and paying for these services.

4.2 Delivery

    Some Sellers may offer delivery to selected areas. In such cases:

  • The Seller acts as the fulfilling party, not NegosyoNow.
  • Actual delivery times may vary depending on the Seller and/or their fulfillment partner.
  • The transaction is considered complete once the Seller hands over the goods to you or your authorized representative at your specified destination.
  • NegosyoNow is not liable for:
    • Delivery delays
    • Missed delivery
    • Condition of goods upon arrival
    • Handling issues
    • Any incidents occurring during Seller-managed transport

4.3 Other Logistics Arrangements

    Some Sellers may support additional logistics methods such as bus shipping or other third-party transport services.

  • These transactions are considered complete upon turnover of goods to the shipper.
  • NegosyoNow and the Seller's involvement does not extend or transfer liability for any events during or after shipment.
  • You remain responsible for providing accurate consignee details and for monitoring the shipment directly with the carrier.

4.4 Other Requirements

    To ensure smooth facilitation:

  • Please be ready with the transaction reference to ensure that the correct items are handed over
  • Valid proof of identification and/or written authorization prior to releasing any items.
  • Kindly ensured that the designated contact number(s) reachable on the target date
  • Relay all fulfillment instructions and details to your representative (e.g. delivery time, waiting time, pick up hours, etc)

If special packaging is required (e.g., styrofoam coolers, insulated boxes, ice packs), packaging fees must be settled in accordance with the Payments section.

5. PAYMENTS

The amounts shown at checkout are estimates only. Before any payment option becomes available, the Seller must first confirm the following details:

  • Available Quantities
  • Proposed Changes or Item Adjustments
  • Additional Fees and Charges (e.g. packaging, handling, special transport)
  • Special Instructions (including downpayment requirements, if any)

The Buyer must review and approve these details.

Only after approval will the final modes of payment be presented. Please note that payment options may change. Wait for the final payment instructions before sending money or making any deposits.

All payments must be made exclusively through official channels and authorized representatives. Payments made outside the prescribed methods may not be honored and may result in delays or cancellation of the transaction.

6. RETURNS AND ISSUES

Concerns regarding goods received or picked up must be reported within 7 days of receipt through our official communication channels.

  • Resolutions are handled on a case-by-case basis.
  • Supporting evidence (photos, videos, receipts) may be required.
  • NegosyoNow reserves the right to approve or deny return or replacement requests based on the circumstances.

7. LINKS TO THIRD-PARTY WEBSITES OR SERVICES

The Service may contain links to third-party websites or services not owned or controlled by NegosyoNow.

NegosyoNow has no control over and assumes no responsibility for:

  • Content
  • Policies
  • Security
  • Availability
  • Practices

You acknowledge that NegosyoNow is not liable for any damage or loss arising from your use of or reliance on third-party websites or services.

8. DATA PRIVACY COMPLIANCE

NegosyoNow processes personal data in accordance with The Data Privacy Act of 2012 (RA 10173) and The General Data Protection Regulation (GDPR), where applicable.

We collect only the data necessary to fulfill transactions, operate the platform, and comply with legal obligations.

Your rights under DPA and GDPR—including access, correction, erasure, objection, portability, and withdrawal of consent—are detailed in our Privacy Policy.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • NegosyoNow is not liable for indirect, incidental, or consequential damages.
  • NegosyoNow is not responsible for losses arising from third-party couriers or customer-selected representatives.
  • NegosyoNow's liability is limited to the value of the transaction in question.

Nothing in these Terms limits rights granted under consumer protection laws.

10. CHANGES TO THESE TERMS AND CONDITIONS

We may update these Terms and Conditions from time to time.

Material changes to these Terms and Conditions are changes that significantly affect how we process your personal data, your privacy rights, or the risks to you as a data subject. When we make material changes, we will notify you 7-14 days prior to implementation through email and/or a prominent notice on our Platform.

We assess whether a change is material based on its impact on your privacy rights and how your personal data is processed, in line with applicable data protection laws.
